    As a biochemist of very considerable experience in the patent profession, Richard’s career has encompassed all of the major biotech patenting developments since the European Patent Office opened in 1978. In the late 1970s, Richard provided the European representation for Cetus Corporation covering matters ranging from protein isolation, through initial recombinant technology applications, to the first PCR cases. Richard advised the MRC in relation to the early genomics cases, and filed the MRC’s initial genomics case as well as spin-off technology from the human genome project.

     

    Richard has provided representation in a list of very high profile cases at the European Patent Office at all levels, including PCR, the Harvard oncomouse case, the recombinant relaxin case, patentability of genomics (including obtaining patent grant on appeal for a ZymoGenetics case which has been regarded as seminal in biotech patentability, having been relied upon in judgements of the English Court of Appeal and Supreme Court), Schering AG’s successful attack against Biogen’s IFN Beta case, Protein Design Labs and humanised antibodies, and many many more.

     

    Richard is recognised as one of the leading practitioners in Europe in relation to oppositions and related contentious proceedings, having very considerable experience in running opposition teams and related litigation. His experience of and familiarity with the Boards of Appeal at the EPO is of immense value to clients and, as the Director responsible for contentious proceedings, Richard inevitably deals with clients at all levels and in all commercial circumstances.

    Richard has handled a number of standard and “non-conventional” cases spanning, antibodies, vaccines and small molecule drugs. This unique experience resulted in Richard’s filing of SPC applications for each of the only two antibody drug conjugates (ADCs) presently approved in Europe.

    Richard is continuously recognised in peer review assessments of leading practitioners.

    Paul has almost 30 years experience of working in Intellectual property in the Life Sciences field. He began his career working in private practice in the 1980s, during the early days of the Biotech industry. He then spent several years in house in a multinational pharmaceutical company, which gave him a useful perspective on the commercial importance of IP, both from the point of view of protecting new products and also clearing a path for a company’s commercial activities. He then returned to private practice and spent over 20 years at a major London firm, 17 of them as a partner.

     

    Paul has worked for individual clients, for start up companies and SMEs, for Universities and for larger corporate clients. His experience ranges across all areas of IP including, initial drafting and prosecution of patents, developing and managing patent portfolios, developing IP strategies, IP due diligence and IP transactional work, including stock exchange listings. As well as these he also has a wealth of experience in EPO Opposition and Appeal proceedings.

     

    In terms of technology, Paul’s practice covers all the “conventional” aspects of Life Sciences, from NCEs through gene technologies, immunology, pharmaceutical formulations, drug delivery technologies, manufacturing processes and medical devices. Particular highlights include working on the original PCR patent filings before the EPO, the Harvard Mouse case, which helped define the patentability of animals before the EPO and working on the original Roslin Institute case covering the cloning of Dolly the sheep.

     

Dr Gwyn Cole

    Gwyn has many years of experience in patent drafting, prosecution, oppositions and appeals in his specialist areas of pharmaceutical and healthcare industries. This has been broadly based and includes neurologicals, anti-inflammatories, anti-cancer agents, cardiovascular medications, vaccines and antibodies for medical use.

    In the pharmaceutical area, Gwyn has managed legal teams in several European Countries involved in infringement and revocation actions before the Courts and he is a former member of the Intellectual Property Committee of the UK’s Pharmaceutical Manufacturers Association.

     

    Gwyn previously set up the Intellectual Property Department of Smith & Nephew plc and headed Merck & Co Inc’s patent department in Europe where he was responsible for obtaining patents in Europe on what were then the world’s biggest selling pharmaceutics such as Zocor.  In the last few years Gwyn has continued to work with potential blockbusters and has obtained the European patents on what are or will be major pharmaceuticals such as Lesinurad (to be marketed by AstraZeneca) and Ibrutinib (marketed by Janssen-Cilag) which is confidently expected to become the biggest selling pharmaceutical of all time (and formed the basis of the recent over €20 billion sale of its developer Pharmacyclics).

     

    As a senior figure in the pharmaceutical industry, Gwyn was involved in some of the first SPCs in Europe including the lobbying process that led to the establishment of the European SPC system. He then obtained a series of SPCs on what were at the time Europe’s largest selling pharmaceuticals such as Simvastatin, Enalapril, Lisinopril, Ivermectin and Losartan.  He obtained the first SPCs on combination products, for example on antihypertensive agents together with hydrochlorothiazide and pioneered obtaining multiple SPCs from a single patent.  His activities in SPCs have continued to the present day and he has, within the last few months, managed filings throughout Europe of SPCs in respect of Ibrutinib, which will eventually add many billions of dollars in sales to the product.

    After training and qualifying in private practice, Ross worked as Intellectual Property Counsel in-house at a multinational pharmaceutical company. This experience enabled Ross to develop broad legal and strategic experience not only in managing large patent prosecution portfolios, but also providing strategic advice in relation to patent and SPC litigation, merger and acquisition due diligence and pharmaceutical product development, clearance and launch strategies.

     

    Ross’ technical patent experience encompasses most aspects of biotechnology, pharmaceuticals and medical devices, in particular in fields such as immunology, cell biology, genomics, microbiology, cancer therapeutics and drug delivery. Ross is experienced in biotech patent drafting, global and European patent prosecution, European Freedom-to-Operate assessment and European Oppositions and Appeals.

     

    In private practice, Ross has worked with a range of domestic and international companies from universities and small start-ups, through to medium and large biotech and pharmaceutical companies.  While in house, Ross managed a large portfolio of respiratory products, providing Intellectual Property support to multiple respiratory product development teams, including patent and design clearance, invention capture and life cycle management strategy.

    Suleman specialises in the genomics and immunology areas. He has handled patent cases involving novel genes, T cell and genetic diagnostics, engineered enzymes, crystal structures, antibodies, immuno-tolerisation, vaccines and screening assays.

     

    Suleman has drafted patent applications for small and medium sized biotech companies, large pharmaceutical companies and technology transfer offices. He has prosecuted biotech cases in many different territories and has built up knowledge of biotech case law around the world, and in particular has developed examination strategies for US patent cases. Suleman has extensive experience in both attacking and defending cases in oppositions at the EPO. He has also handled many appeal cases at the EPO and has experience of how strategy needs to be different from first instance proceedings.

     

    Suleman was part of the Human Genome Sciences litigation team in the UK proceedings HGS v Eli Lilly. He has worked closely with technology transfer offices and biotech research companies assisting in aligning patent strategy with commercial goals. In particular he has advised on invention harvesting, building patent portfolios, due diligence and working with investors.

Dr Andrea Hadfield

    Certificate in Intellectual Property Law, Queen Mary, University of London; D.Phil Molecular Biophysics; BA (Hons) Physics (Oxford).

     

    Andrea is a technical expert in a very broad range of biotechnology, having had twenty five years experience in Life Sciences research. Andrea spent some time shadowing in a patent department at a multinational pharmaceutical company, before joining Avidity IP. She has experience of European prosecution of patents for a range of clients. She has worked on Oppositions from the perspective of the patentee and opponent and has acted an assistant at the EPO Board of Appeal in Munich.

     

    Andrea has technical experience in areas from viruses to pharmaceuticals, molecular biology to crystallography, from biosynthesis of antibiotics to biodegradation of oil pollution. Starting with a Physics degree, followed by a Molecular Biophysics PhD, Andrea pursued a career in research, spending four years in the United States, returning to the UK to become a tenured Senior Lecturer in Biochemistry. She set up a small scientific consultancy business Xtalsolutions, before working full time as a senior scientist in drug discovery and lead development at Evotec.

     

    Andrea has therefore worked in-house on research projects ranging from MOD projects to drug design, run a University Research group and work in research for a start-up company, and has an understanding of the process of technology transfer from both sides as well as a working knowledge of a very broad range of technologies.

    Adam qualified in private practice then worked in-house for several years for a microprocessor IP licensing business before returning to private practice at the beginning of 2015.  He has experience across the patent life cycle from initial invention harvesting through drafting and prosecuting patent applications to managing patent portfolios.

     

    Adam’s drafting and prosecution experience includes simple mechanical devices for use in the fast moving consumer products and automotive industries, microprocessors and electron microscopes, and software.  He has undertaken freedom to operate work and challenged the validity of his clients’ competitors’ patents.

     

    He particularly enjoys working with inventors to get a thorough understanding of their technologies.

In this regard he was involved in the development process for what is now a market leading insulin injector, securing a portfolio of patent rights around the developed technology.

     

    John has broad experience across the full IP spectrum of patents, trade marks, copyrights and designs working for individuals, SMEs and multi-national companies. John’s patent practice primarily concerns protection for mechanical devices, while his trade mark practice includes not only engineering companies, but also companies in the FMCG, agriculture, electronic goods, gaming and service company sectors. Gary is also highly active in Trade/Service Marks and the protection of industrial designs, is a keen listener and wants to deliver advice to suit your IP requirements and budgets.

     

    Gary is a former equity partner from a London based practice, where he was responsible for all chemical and materials cases entrusted to his firm but particularly from a major Japanese multinational and several of the London Universities. Industrial experience was gained within an American based chemicals multinational where he also oversaw their confidentiality agreements and portfolio maintenance conferences.

Anthony Williams

    Anthony comes from a background in both client-facing IP administration as head of Formalities for a previous private practice firm, and prior to that an in-house role in IP procurement, administration and licencing. Building on this broad wealth of knowledge and experience Anthony is now a part-qualified European Patent and Trade Mark Attorney, looking to qualify as a European Trade Mark Attorney in 2017.

    Presently Anthony splits his time between managing Avidity’s extensive Formalities and Records Department and continuing his training as an Associate Attorney. In his Attorney role Anthony’s focus is Trade Marks and Branding, and is well placed to advise on filing and prosecution strategies, assessing and covering core geographical markets, and implementing processes and tools for the ongoing enforcement of those IP rights globally.

    Having been responsible for the procurement and transfer of intellectual property assets on behalf of a variety of investment portfolios Anthony is well experienced in the assessment, valuation and sale of IP rights, and applies those same tools to assessing client’s proposed IP filings and acquisitions.
